By Definition:
Speeding section 128 of the Highway Traffic Act
No person shall drive a motor vehicle at a rate of speed greater than:
a) 50 kilometers per hour on a highway within a local municipality or within a built up area
b) Despite clause (a), 80 kilometers per hour on a highway, not within a built-up area, that is within a local municipality
c) 80 kilometers per hour on a highway designated as a controlled-access highway whether of not the highway is within a local municipality
d) The rate of speed prescribed for motor vehicles on a highway in accordance with subsection (2), (5), (6), 6.1) or (7) under section 128 of the Highway Traffic Act
e) The Maximum rate of speed set under subsection (10) and posted in a construction zone designated under subsection (8) of (8.1) under section 128 of the Highway Traffic Act
Demerit Points:
Speeding 0 to 15 over the posted limit: 0 demerit points
Speeding 16 to 29 over the posted limit: 3 demerit points
Speeding 30 to 49 over the posted limit: 4 demerit points
Speeding 50 or more over the posted limit: 6 demerit points
Fines:
Speeding 0 to 19 over the posted limit: $2.50/km over the limit
Speeding 20 to 29 over the posted limit: $3.75/km over the limit
Speeding 30 to 49 over the posted limit: $6.00/km over the limit
Speeding 50 or more over the posted limit: Upon conviction, $9.75/km over the limit
Other Penalties:
A novice driver holding a G1, G2, M1 or M2 license will receive a 30 day suspension if convicted of an offence of 30 over the posted limit or higher

By Definition:
Disobey Stop Sign section 136(1)(a) of the Highway Traffic Act
Every driver or street car operator approaching a stop sign at an intersection shall stop his or her vehicle or street car at a marked stop line or, if none, then immediately before entering the nearest crosswalk or, if none, then immediately before entering the intersection.

By Definition:
Disobey Sign sections 144(9) and 182(2) of the Highway Traffic Act
144(9): The provisions of this section are subject to any sign, as prescribed by regulation, forbidding a left turn, right turn, through movement or a combination thereof that is posted at an intersection. Every driver shall obey such signs.
182(2): Every driver shall obey the instructions or directions indicated on any erected sign.

By Definition:
Fail to wear seat-belt section 106(2) of the Highway Traffic Act
Every person who drives a motor vehicle on a highway in which a seat belt assembly is provided for the driver shall wear the complete seat belt assembly.

By Definition:
Fail to Report an Accident section 200(1) of the Highway Traffic Act.
Every person in charge of a motor vehicle who is directly or indirectly involved in an accident shall if the accident results in personal injuries or in damage to property exceeding the amount prescribed by regulation, report the accident forthwith to the nearest police officer or reporting centre.

By Definition:
Follow Too Closely section 158(1) of the Highway Traffic Act
The driver of a motor vehicle shall not follow another vehicle or streetcar more closely than is reasonable and prudent having due regards for the speed of other vehicles, the traffic and the conditions of the highway.

CARELESS DRIVING: HTA 130
By Definition:
Careless Driving section 130(1) of the Highway Traffic Act
Every Person is Guilty of the offence of Driving carelessly who drives a vehicle or street car on a highway without due care and attention or without reasonable consideration for other persons using the highway.
Demerit Points:
For a fully licensed driver holding a class ‘G” license: 6 demerit points
For a G1, G2, M1 or M2, license: A 30 Day license suspension for a first offence
Fines:
$400 to $2000 plus court costs and the victim fine surcharge
Other Penalties:
Along with the fine, the courts can also impose a term of imprisonment of up to 6 months and may suspend your driver’s license for up to two years.

ADDITIONAL INFORMATION
By Definition:
Careless Driving Causing Bodily Harm or Death section 130(3) of the Highway Traffic Act.
Every Person is guilty of the offence of driving carelessly who drives a vehicle or street car on a highway without due care and attention or without reasonable consideration for other persons using the highway and who causes bodily harm or death to any person.
Demerit Points:
For a fully licensed driver holding a class ‘G” license: 6 demerit points
For a G1, G2, M1 or M2, license: A 30 Day license suspension for a first offence
Fines:
$2000 to $50,000 plus court costs and the victim fine surcharge.
Other Penalties:
Along with the fine, the courts can also impose a term of imprisonment of up to two years and may suspend your driver’s license for up to five years.

By Definition:
Hand-held Communication Device section 78.1(1) of the Highway Traffic Act
No person shall drive a motor vehicle on a highway while holding or using a hand-held wireless communication device or other prescribed device capable of receiving or transmitting telephone communications, electronic data, mail, or text messages.
Demerit Points:
For a fully licensed driver holding a class ‘‘G” license: 3 demerit points for a first conviction For a G1, G2, M1, or M2, license: An escalating penalty system that may include further suspensions of your driver's license as well as demerit points
Fines:
$500 to $1000 for a first Offence plus court costs and the fine victim surcharge
$500 to $2000 for a second Offence plus court costs and the fine victim surcharge
$500 to $3000 for a third Offence plus court costs and the fine victim surcharge
Other Penalties:
If convicted of an Offence under this section, your driver’s license will be suspended for:
1st Offence: three days
2nd Offence: seven days
3rd Offence: thirty days

By Definition:
Stunt Driving / Racing section 172 of the Highway Traffic Act
No person shall drive a motor vehicle on a highway in a race or contest, while performing a stunt or on a bet or wager
Demerit Points:
6 demerit points
Fines:
$2000 to $10,000 plus court costs and the victim fine surcharge
Other Penalties:
In addition to the fines, the court can impose a term of imprisonment of not more than six months as well as suspend your drivers license for up to two years for a first conviction.

By Definition:
Fail to Stop for Emergency Vehicle section159(1) of the Highway Traffic Act
The driver of a vehicle, upon the approach of a police department vehicle with its bell or siren sounding or with its lamps producing intermittent flashes of red light or red and blue light, or upon the approach of an ambulance or fire department vehicle shall immediately bring such vehicle to a standstill,
a) as near as is practicable to the right-hand curb or edge of the roadway
b) when on a roadway having more than two lanes for traffic and designated for the use of one-way traffic, as near as practicable to the nearest curb or edge of the roadway
Demerit Points:
3 demerit points
Fines:
$400 to $2000 plus court costs and the victim fine surcharge
Other Penalties:
If you are convicted of this offence, the court may make an order suspending your driver’s license for a period of not more than two years.
If you commit this offence twice within a 5-year period you are liable for a fine from $1000 to $4000, or to imprisonment for a term of not more that six months, or both.

By Definition:
Fail to Slow Down on Approaching Stopped Emergency Vehicle 159(2) and 159(3) of the Highway Traffic Act
159(2): The driver of a vehicle upon approaching an emergency vehicle with its lamp producing intermittent flashed of red or red and blue light that is sopped on the same side of a highway, shall slow down and proceed with caution having regard for the traffic, weather and conditions of the highway.
159(3): In addition to slowing down and proceeding with caution, the driver shall move into another lane if the movement can be made safely.

$400 to $2000 plus court costs and the victim fine surcharge
Other Penalties:
If you are convicted of this offence, the court may make an order suspending your driver’s license for a period of not more than two years.
If you commit this offence twice within a 5-year period you are liable for a fine from $1000 to $4000, or to imprisonment for a term of not more that six months, or both.

By Definition:
Fail to Stop for School Bus (meeting) section 175(11) of the Highway Traffic Act
Every driver, when meeting on a highway, other than a highway with a median strip, a stopped school but that has its overhead red signal-lights flashing, shall stop before reaching the bus. The driver shall not proceed until the but moves or the overhead red signal-lights have stopped flashing.
Fail to Stop for School Bus (approaching) section 175(12) of the Highway Traffic Act
Every driver, when approaching from the rear a stopped school bus that has its overhead red signal-lights flashing, shall stop at least twenty metres before reaching the bus. The driver shall not proceed until the bus moves or the overhead red signal-lights have stopped flashing.
Demerit Points:
6 demerit points
Fines:
$400 to $2,000 plus court costs and the victim fine surcharge
Other Penalties:
If you contravene this section a second time you are liable for a fine of $1,000 to 4,000 or to imprisonment for a term of not more than six months, or to both.
If you carry a G1 or G2 Licence your drivers’ licence may be suspended for 30 days.

By Definition:
Fail to Remain at the scene of an accident section 200(1) of the Highway Traffic Act.
Where an accident occurs on a highway, every person in charge of a vehicle that is directly or indirectly involved in the accident shall remain at or immediately return to the scene of the accident. They shall also render all possible assistance and upon request, give in writing to anyone sustaining loss or injury or to any police officer or to any witness, their name, address, driver’s license number, insurance information, vehicle owner information and the permit number.
Demerit Points: 7 demerit points
Fines:
$400 to $2,000 plus court costs and the victim fine surcharge
Other Penalties:
Along with the fine, if you contravene this section you are liable to possible imprisonment for not more than six months and up to a two-year licence suspension.
If you carry a G1 or G2 Licence your drivers’ licence may be suspended for 30 days.
